professional is not liable for an injury to or the death of a participant in
equine activities resulting exclusively from the inherent risks of equine
activities.
Chapter 99E of the North Carolina General Statutes."
The Client represents and acknowledges that the care, use, training and riding
of a horse is inherently difficult and dangerous and involves substantial risk
both to individuals, their property and their animals, including, but not
limited to 1) the propensity of equines to behave in dangerous ways which may
result in injury; 2) the inability to predict an equine’s reaction to sounds,
movements, objects, persons, or animals; and 3) hazards of surface or subsurface
conditions, both known and unknown. Therefore, the client agrees to assume all
risks, direct or indirect, associated with the maintenance, care, use, training,
or riding of any horse or of any equestrian facility involved in the training of
the client or their horse(s).
The Client agrees to assume all liability and to indemnify and hold harmless
the Phillips Farm for any and all injury, losses, or damages (including expenses,
claims, actions or liabilities including attorneys fees) related to any person,
animal , or property, to the persons or property of the Client or the Phillips
Farm,
their guests, agents or invitees or any other person or their property,
including but not limited to the horse being trained or ridden by or for the
Client or other horses and pets, which arises from, is connected with, or is in
any manner related to or caused, directly or indirectly, by any action or
omissions of the Phillips Farm, Client, their guest’s, agents’, or invitees’ training,
handling, care, or use of the facilities or riding of any horse or other
activity.
